Terms and Conditions

1. Scope and Contracting Party

These Terms and Conditions apply to all agreements between Bactericayana GmbH (Share capital 10,000 €, Managing Director: Verena Steiner), Jakominiplatz 14, 8010 Graz, Austria, and its clients. These terms are supplemented by the provisions of the Consumer Protection Act (KSchG) and the Distance and Off-Premises Contracts Act (FAGG).

2. Orders and Contract Formation

A binding contract is formed when the client submits a formal order via the contact form at /en/contact.html or by email to [email protected], and Bactericayana GmbH confirms this order. A minimum order value of 30 € applies to all individual projects.

3. Pricing, Taxes, and Payment

All prices listed on the website include the statutory VAT of 20%. For business customers (B2B), the net amount is specified. Final pricing is calculated based on the actual engraving area or the linear meters of the cut, as defined in our services overview.

For B2B clients, the payment term is 14 days following the date of the invoice.

4. Deposits and Cancellations

To secure the production slot, a deposit of 50% of the total order value is required. Production commences only after receipt of the deposit and final approval of the layout. In the event of a cancellation after the laser cutting or engraving phase has begun, the deposit is non-refundable as the item is a custom-made product.

5. Production Process and Amendments

Clients are responsible for providing print-ready vector data. Should layout preparation be performed by us, it will be charged separately based on hourly rates. Design changes made after final approval may incur additional costs. Express orders are subject to a surcharge of 30% of the total price.

6. Ownership and Usage Rights

Bactericayana GmbH reserves the right to use photographs of finished products for reference purposes (all photos are illustrative). The client guarantees that they possess all necessary rights to the logos and fonts submitted for engraving or cutting. Liability for copyright infringements rests solely with the client.

7. Liability and Warranty

Liability for slight negligence is excluded to the extent permitted by law. We are not liable for material defects caused by materials provided by the client. Complaints must be reported in writing to [email protected] within 7 days of receiving the goods.

8. Right of Withdrawal and Consumer Protection

According to the FAGG, there is no statutory right of withdrawal for goods made to the customer's specifications (custom-made items). This specifically applies to personalized gifts, engraved signs, and bespoke laser cuts.

9. Final Provisions and Jurisdiction

Austrian law applies. The place of jurisdiction for all disputes arising from this contractual relationship is Graz. Should any provision of these terms be invalid, the validity of the remaining provisions shall remain unaffected. For questions regarding data processing, please refer to our privacy policy.
